Medical Malpractice and Other Professional Malpractice

The estate of an 18 year old woman and her newborn child sued several hospitals and physicians for failure to diagnose and treat a fungal infection. The woman was near term in her pregnancy and had been admitted to the hospital with exacerbation of asthma. She died from the infection a few days after giving birth. Successfully settled after suit was filed. 


The estate of a young woman sued the surgeon and hospital for her death from cardiac and respiratory arrest that occurred within a few hours of being discharged from the hospital following kidney transplant surgery. Successfully settled after suit was filed.
An elderly woman sued her cardiologist for failure to monitor the administration of Coumadin, a blood thinning medicine. As a result, the dose she had taken was greater than necessary and she suffered a hemorrhage in her brain (stroke). This case was successfully settled by the Wimer Law Offices firm on the day that trial was to begin.
A man sued a hospital for failure to diagnose a subarachnoid hemorrhage (bleeding in the brain) in its emergency room. The man survived but required nursing home care for years. Successfully settled by Wimer Law Offices in Pittsburgh. 
A woman sued her cosmetic surgeon for a poor result from facial lift surgery that resulted in permanent scarring and uneven facial features. Successfully settled after suit was filed.
The parents of a minor male sued a physician for failure to diagnose their son’s testicular torsion condition. Successfully settled after suit was filed.
A woman sued her pharmacy for an error in filling her insulin prescription that resulted in a severe hypoglycemic episode. Successfully settled before suit was filed.
Motor Vehicle Accidents
The parents of a 13 month old child brought suit against an ice cream truck business and its owners after the little boy was struck by the truck and killed. The ice cream truck did not have the required safety equipment that would have allowed the driver to see the young child. Successfully settled during mediation after suit was filed. Settlement monies were used to establish a play area in a local park near the family’s home so that other children could have a safe environment in which to play.
A supervisor of a masonry company was the driver of a car that was rear-ended at an intersection. He suffered neck injuries from the impact. The case was tried to a jury in Allegheny County over 2 days. The jury returned a verdict in favor of the injured supervisor.
A 22 year old man was a front seat passenger involved in a car accident in Mt. Lebanon. The car was overturned and he suffered injuries to his hand that required surgery to repair. Successfully settled after suit was filed.
A 52 year old man was the driver of a car involved in a multiple car collision in Beaver County. He suffered a fractured knee and other knee injuries and a head injury that resulted in damage to his vision. Successfully settled after suit was filed.
Premises Liability- Slip and Fall
A woman tripped and fell in a hospital parking garage on an uneven floor and she sustained soft tissue injuries. Successfully settled after suit was filed.

A 55 year old woman slipped and fell on wet leaves at her apartment building. She suffered a fractured arm and rotator cuff damage. Successfully settled by Wimer Law Personal Injury Lawyers before suit was filed.


A 75 year old woman was seriously injured at a private country club upon entering the building for an anniversary party. While walking along the main pathway to the banquet hall, she encountered the top of the landing of the stairway hidden behind a wall and she fell sideways and head first down the flight of stairs. She suffered severe and permanent head injuries. Successfully settled before suit was filed.


A woman tripped on uneven sidewalk pavement at a state university. She suffered multiple fractures to her arm and hand that required surgery. Successfully settled after suit was filed in Butler County.


A woman tripped and fell exiting an elevator because the elevator was not leveled correctly with the floor. She suffered a broken wrist. Premises Liability- Burns
An elderly woman suffered severe burns from dangerously hot water in tub in her apartment. She died 2 months later from medical complications that resulted from the burns. The owner of the apartment complex was sued for not having temperature control on hot water lines to apartment. Successfully settled during mediation after suit was filed.


A waitress at a restaurant spilled hot soup on 20-month old child which caused second degree burns to child. Successfully settled before suit was filed.


A 38 year old woman who had been working in the kitchen of a bar sustained third degree burns to her legs while emptying the grease out of the fryer to clean the equipment. She underwent skin graft surgeries to several of the burns and was left with permanent scars. Because the bar had let its workers’ compensation insurance lapse, the woman was permitted to sue the bar in the Court of Common Pleas. The case was tried to a jury in Allegheny County over 3 days. The jury returned a verdict in favor of the injured woman.


Premises Liability- Deck Collapse
A young adult woman was standing on a deck of an apartment and the deck collapsed without warning. She sustained a broken foot. The apartment building owner, who had personally constructed the attached deck, was sued for negligence in designing and building the deck. Successfully settled before suit was filed.
Premises Liability- Dog Bites
A woman who was working for the county rodent control unit was bitten by pit bull dogs. She sued the owner of the rented property she was servicing because she had asked him about dogs on the property and he represented that the yard was safe and opened the gate for her. Dogs attacked and bit her. In addition to requiring care for the bite wounds, she required a series of rabies vaccine shots because the dogs had not been vaccinated against the disease. Successfully settled after suit was filed.
A young child was bitten by a dog and suffered a terrible injury to her nose. Successfully settled by Wimer Law Personal Injury Attorneys after suit was filed in Butler County.
Premises Liability- Poisoning
A mother and 2 children suffered carbon monoxide poisoning from a faulty furnace in their apartment. The owner of the apartment was sued for negligent upkeep of furnace. Successfully settled before suit was filed.
Defective Products
A 68 year old woman with Multiple Sclerosis purchased a special pillow that had been marketed for use in wheelchairs. Despite having used a wheelchair for the past 13 years with no history of decubitus ulcers (skin breakdown), she developed a severe decubitus ulcer within days of using pillow that resulted in 14 months of medical case and she underwent numerous surgical procedures to treat the ulcer. Successfully settled after suit was filed.
Other Cases- Identify Theft
A teenager was sued by a person who claimed that the teen had provided a false social security number to police after being arrested for shoplifting. The erroneous social security number was the actual number of the person making the claim. A major retail store was sued also because its security personnel, who had stopped the youth, did not verify the accuracy of number. The arbitration board found that the teen had not provided a false social security number and that he owed no damages to the plaintiff.
Other Cases- Landlord-Tenant
A woman was sued by her former landlords for unpaid rent and claimed damages to the property. At the arbitration hearing, she successfully counter-sued the former landlords for breach of implied warranty of habitability by showing the poor conditions of the premises and lack of repairs that made the apartment unsuitable for human occupation.
Other Cases- Fraud and Consumer Protection
The homeowner sued the provider of plumbing services for fraud, negligent misrepresentation, violation of the Unfair Trade Practices and Consumer Protection Law and conversion. She had contacted the plumbing company to evaluate and repair her home’s blocked sewer line. The company misrepresented the condition of plaintiff’s sewer system, advising her that there were no pipes underneath her basement and that the entire sewer system running from the trap back into the house and also running from the trap out to the street required replacement. The company showed the homeowner what was represented to be a camera view of the condition of the sewer in her home. The company began to work on the project. Because of the high cost of the repairs, the homeowner obtained a second opinion from a different plumbing company and its inspection of her sewer system revealed that the system was intact and did not need to be replaced. The homeowner incurred expenses in replacing parts of the sewer system that did not need to have been taken out, in replacing her garage floor that was jack hammered, in repairing the driveway in the area of the trap and in repairing the basement floor in the area of the basement drain. Successfully settled after suit filed.
